Special Session E of the Florida Legislature

Ch. 2003-418 (H.B. 35-E)  Permits the governor to issue a one-time stay preventing the withholding of nutrition and hydration in certain circumstances; provides for immunity for persons complying with such a stay; provides for appointment of a guardian ad litem for a person subject to such a stay. Effective October 21, 2003.

Ch. 2003-419 (C.S. for S.B. 8-E)  Exempts certain information, research materials, actual and potential trade secrets, proprietary business information, and meetings held by the Scripps Florida Funding Corporation or the Office of Tourism, Trade and Economic Development from public records and public meetings requirements; provides an exception. Effective November 3, 2003.

Ch. 2003-420 (C.S. for C.S. for S.B. 6-E)  Creates and revises provisions relating to economic development, including creation of the Scripps Florida Funding Corporation. Effective November 3, 2003.

Ch. 2003-421 (H.B. 5-E)  Re-creates the Biomedical Research Trust Fund; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective July 1, 2004.

Ch. 2003-422 (C.S. for S.B’s. 14-E and 16-E)  For workers’ compensation purposes, provides that certain construction contracting licensees are not required to obtain approval for change of status or to obtain a specified license or certificate of authority until July 1, 2004; enumerates change of status requirements and procedures; redefines the term “corporate officer.” Effective November 12, 2003.

Ch. 2003-423 (C.S. for S.B. 18-E)  Revises provisions relating to phosphate mining; provides for studies; appropriates funds. Effective November 12, 2003.

Ch. 2003-424 (S.B. 22-E)  For the 2003-2004 fiscal year, sets a limit on the amount of tax credits that may be granted for contributions to certain scholarship funding organizations and provides additional funding for the Florida Education Finance Program. Effective November 12, 2003.

Ch. 2003-425 (H.B. 23-E)  Exempts certain persons in the defense, space, and aerospace industries from licensure as professional engineers; revises provisions relating to use of professional engineering titles. Effective November 12, 2003.

Ch. 2003-426 (H.B. 43-E)  Provides for the transfer of specified unclaimed lottery prize money to the Educational Enhancement Trust Fund; provides for certain appropriations and allocations.  Effective November 12, 2003.

Ch. 2004-1 (C.S. for S.B. 2000)  Revises and repeals provisions relating to the Florida KidCare Program. Effective March 11, 2004, except as otherwise provided.

Ch. 2004-2 (C.S. for S.B. 2002)  Creates and revises provisions relating to health care initiatives. Redesignates the Florida Alzheimer’s Center and Research Institute as the Johnnie B. Byrd, Sr., Alzheimer’s Center and Research Institute and the Life Sciences Building at Florida State University as the James E. “Jim” King, Jr., Building. Effective March 11, 2004, except as otherwise provided.

Ch. 2004-3 (S.B. 282)  Provides an additional circumstance under which a person not in possession of a lost, destroyed, or stolen negotiable instrument may enforce such instrument. Effective March 29, 2004.

Ch. 2004-4 (S.B. 1532)  Designates portions of the Florida Statutes 2004 which constitute the official statute law of the state. Designates general laws which are, and which are not, repealed by the adoption of the Florida Statutes 2004. Effective June 29, 2004.

Ch. 2004-5 (S.B. 1534)  Amends, repeals, or reenacts various provisions in the Florida Statutes to replace incorrect cross-references, delete obsolete or expired provisions, correct grammatical and typographical errors, remove inconsistencies and redundancies, and otherwise improve the clarity of the statutes. Effective June 29, 2004.

Ch. 2004-6 (S.B. 1536)  Repeals numerous provisions of the Florida Statutes which were repealed other than by a “current session” of the Legislature or repealed to conform to the repeal of a public records exemption in accordance with the Open Government Sunset Review Act of 1995, for the purpose of omitting such provisions from publication in the Florida Statutes 2004. Effective June 29, 2004.

Ch. 2004-7 (S.B. 1538)  Removes gender-specific references to human beings from the Florida Statutes without substantive change in legal effect. Effective June 29, 2004.

Ch. 2004-8 (H.B. 103)  Requires certain health care practitioners to include specified information on prescriptions; provides a presumption of validity for certain prescriptions. Effective July 1, 2004.

Ch. 2004-9 (H.B. 317)  Exempts building plans and related documents concerning specified facilities from public records requirements. Provides for future review and repeal. Effective March 29, 2004.

Ch. 2004-10 (H.B. 539)  Revises provisions relating to guidelines and standards for developments of regional impact. Effective July 1, 2004.

Ch. 2004-11 (C.S. for C.S. for S.B. 192)  Revises various provisions to redesignate “magistrates” as “trial court judges” and “masters” and “general or special masters” as “general or special magistrates.” Effective October 1, 2004.

Ch. 2004-12 (H.B. 129)  Creates, revises, and repeals provisions relating to elevator safety. Effective April 6, 2004, except as otherwise provided.

Ch. 2004-13 (H.B. 325)  Revises provisions relating to specified payments by mobile home park owners to the Florida Mobile Home Relocation Corporation. Effective April 6, 2004.

Ch. 2004-14 (C.S. for S.B. 118)  Requires that a court not accept a plea agreement which prohibits certain law enforcement personnel from appearing or speaking at a sentencing, parole, or clemency hearing; provides that certain rights afforded by law or the State Constitution are not impaired. Effective July 1, 2004.

Ch. 2004-15 (H.B. 347)  Includes Nassau County within the Florida Inland Navigation District; conforms provisions; provides for a referendum concerning district ad valorem taxation within Nassau County. Effective April 14, 2004, except as otherwise provided.

Ch. 2004-16 (H.B. 989)  Provides a road and bridge project exemption to a specified water management district; provides for adoption of a no fee general road and bridge permit for certain projects to replace a statutory exemption. Effective April 14, 2004.

Ch. 2004-17 (H.B. 495)  Revises provisions relating to protective injunctions from repeat, sexual, and dating violence; conforms specified provisions. Effective July 1, 2004.

Ch. 2004-18 (H.B. 511)  Provides for establishment of neighborhood crime watch programs by county sheriffs or municipal police departments. Prohibits harassment of crime watch program participants. Effective July 1, 2004.

Ch. 2004-19 (H.B. 529)  Revises provisions concerning transfer of real estate interests and vesting of rights. Effective April 24, 2004.

Ch. 2004-20 (H.B. 1335)  Clarifies the use of amber rotating or flashing lights by wreckers and escort vehicles; requires drivers encountering wreckers performing a recovery or loading on the roadside to take certain precautions. Effective July 1, 2004.

Ch. 2004-21 (H.B. 251)  Creates and revises provisions relating to firefighter and municipal police pensions. Effective April 27, 2004.

Ch. 2004-22 (H.B. 1861)  Requires the Department of Revenue to furnish certain forms used by property appraisers, tax collectors, clerks of the circuit court, and value adjustment boards in counties with populations under 100,000 persons. Effective July 1, 2004.

Ch. 2004-23 (H.B. 941)  Creates and revises provisions concerning dog racing to require permit holders to provide for a greyhound adoption booth, to permit an additional charity racing day to benefit greyhound adoption, and to require other actions related to greyhound adoption. Effective July 1, 2004.

Ch. 2004-24 (C.S. for S.B. 204)  Provides for recording evidence of the purchase of burial rights. Effective July 1, 2004.

Ch. 2004-25 (C.S. for C.S. for S.B. 1294)  Revises provisions relating to the unlicensed or unregistered practice of pharmacy and the filling of certain prescriptions; defines the term “automated pharmacy system” and prescribes the use of such a system. Effective May 11, 2004.

Ch. 2004-26 (C.S. for S.B. 1738)  Provides that certain tax liens relating to unentitled homestead exemptions have a 20-year expiration period rather than a 5-year expiration period. Effective May 11, 2004.

Ch. 2004-27 (C.S. for C.S. for C.S. for C.S. for S.B. 2488)  Revises provisions relating to the Florida Hurricane Catastrophe Fund; provides transitional provisions. Effective May 11, 2004, except as otherwise provided.

Ch. 2004-28 (C.S. for S.B. 2496)  Creates an exemption from public records requirements for specified records held by the Governor’s Advisory Council on Base Realignment and Closure; Enterprise Florida, Inc.; or the Office of Tourism, Trade, and Economic Development. Provides an exemption from public meeting requirements for meetings or portions of meetings held by the Governor’s Advisory Council on Base Realignment and Closure at which confidential records are presented or discussed. Provides for future review and repeal. Effective May 11, 2004.

Ch. 2004-29 (H.B. 11)  Requires the Department of Highway Safety and Motor Vehicles to retain specified records for 10 years. Effective July 1, 2004.

Ch. 2004-30 (H.B. 221)  Prohibits conducting any event that includes or provides a forum for self-murder; prohibits deliberately assisting in self-murder; provides penalties; provides an exception for simulated self-murder. Effective May 11, 2004.

Ch. 2004-31 (H.B. 457)  Recognizes the Lowry Park Zoo as a state center for Florida species conservation and biodiversity. Effective May 11, 2004.

Ch. 2004-32 (H.B. 635)  Provides an exemption from public records requirements for specified information relating to a child participant in government-sponsored recreation programs or camps. Provides for future review and repeal. Effective May 11, 2004.

Ch. 2004-33 (H.B. 1743)  Revises provisions for fiscal impact statements for proposed constitutional amendments. Effective May 11, 2004.

Ch. 2004-34 (H.B. 1787)  Requires a name change petition to include a copy of the petitioner’s fingerprints and certain criminal background information; provides for dissemination of certain information. Effective July 1, 2004.

Ch. 2004-35 (H.B. 1833)  Provides a public records exemption for certain information relating to valuation of lands held by the Board of Trustees of the Internal Improvement Trust Fund; provides for future review and repeal. Effective July 1, 2004.

Ch. 2004-36 (C.S. for C.S. for S.B. 96)  Mandates that the Department of Citrus develop a process by which persons liable for certain excise taxes may annually object and be afforded a rate reduction; prescribes the use of certain tax funds. Effective July 1, 2004.

Ch. 2004-37 (C.S. for C.S. for S.B. 162)  Limits the effect of judicial determinations issued subsequent to certain development orders under specified circumstances; provides an exception. Effective May 12, 2004.

Ch. 2004-38 (S.B. 226)  Provides for the payment of attorney’s fees and costs for certain actions commenced against law enforcement officers, for jurisdiction relating to costs and attorney’s fees, and a limit on the amount awarded for attorney’s fees and costs. Effective May 12, 2004.

Ch. 2004-39 (C.S. for C.S. for S.B. 284)  Prohibits video voyeurism, video voyeurism dissemination, and commercial video voyeurism dissemination; provides penalties; conforms specified provisions. Effective July 1, 2004.

Ch. 2004-43 (C.S. for C.S. for S.B. 464)  Revises and readopts an exemption from public records requirements for specified information concerning certain employees of hospitals, ambulatory surgical centers, and mobile surgical facilities. Effective October 1, 2004.

Ch. 2004-44 (S.B. 468)  Revises and readopts an exemption from public meeting requirements for portions of hospital board meetings at which confidential written strategic plans are addressed. Effective October 1, 2004.

Ch. 2004-45 (C.S. for C.S. for S.B. 532)  Provides that persons participating in emergency response activities under the direction of or in connection with specified entities are immune from civil liability under certain circumstances. Effective May 12, 2004.

Ch. 2004-46 (C.S. for C.S. for S.B. 712)  Revises and readopts a public records exemption for certain records submitted by a business in eminent domain negotiations concerning business damages. Provides for future legislative review and repeal. Effective October 1, 2004.

Ch. 2004-48 (C.S. for S.B. 1162)  Revises and readopts a public records exemption for certain information held by the Wireless 911 Board or the State Technology Office. Effective October 1, 2004.

Ch. 2004-49 (C.S. for S.B. 1572)  Requires child care personnel to be trained in recognizing and preventing shaken baby syndrome, preventing sudden infant death syndrome, and understanding early childhood brain development. Effective May 12, 2004.

Ch. 2004-50 (S.B. 1626)  Provides an exemption from public records requirements for certain archived materials held by an official archive of a municipality or county; provides an exception; provides for future review and repeal. Effective October 1, 2004.

Ch. 2004-51 (S.B. 1684)  Permits Department of Corrections employees to accept other employment in certain circumstances. Effective May 12, 2004.

Ch. 2004-52 (S.B. 2484)  Creates and revises provisions relating to citrus canker; provides for issuance and execution of agriculture warrants relating to animal and plant pests. Effective May 12, 2004.

Ch. 2004-53 (S.B. 2832)  Requires the South Florida Water Management District to undertake a pilot project to coordinate and, where appropriate, consolidate certain legislatively mandated plans and reports.  Effective May 12, 2004.

Ch. 2004-54 (H.B. 1121)  Creates and revises provisions relating to health care providers. Effective May 12, 2004.

Ch. 2004-55 (S.B. 120)  Prohibits certain sexual offenders from living within 1,000 feet of specified locations; provides for notice to school districts of the location of the residence of certain sexual offenders; and prohibits locating of school bus stops within 1,000 feet of the residence of certain sexual offenders. Effective October 1, 2004.

Ch. 2004-56 (C.S. for C.S. for C.S. for S.B. 1156)  Provides for sport shooting and training range environmental liability protection; requires withdrawal of certain claims within a specified time period; provides a civil cause of action under certain circumstances; specifies state preemption. Effective May 13, 2004.

Ch. 2004-57 (C.S. for S.B. 2306)  Creates the Workgroup on Mammography Accessibility; provides for studies and reports by the workgroup and the Office of Program Policy Analysis and Government Accountability. Effective May 13, 2004.

Ch. 2004-58 (S.B. 2714)  Prohibits unlicensed or unauthorized transmissions to, or interference with, an FCC licensed public or commercial radio station. Effective July 1, 2004.

Ch. 2004-59 (H.B. 155)  Prohibits creation or maintenance of a list, record, or registry of privately owned firearms or the owners of such firearms; provides exceptions. Effective May 13, 2004.

Ch. 2004-60 (H.B. 869)  Prohibits the withholding of adjudication of guilt in certain felony cases; provides for the state’s right to appeal the withholding of adjudication of guilt in certain circumstances; repeals a specified criminal procedure rule. Effective July 1, 2004.

Ch. 2004-61 (H.B. 1313)  Prescribes civil and criminal penalties for flagrant violation of certain net ban provisions; conforms specified provisions. Effective July 1, 2004.

Ch. 2004-68 (S.B. 122)  Provides for a pilot program in certain counties for the purchase of used instructional materials. Effective July 1, 2004.

Ch. 2004-69 (C.S. for S.B. 538)  Creates and revises provisions relating to pugilistic contests and exhibitions. Effective May 20, 2004.

Ch. 2004-70 (C.S. for S.B. 702)  Provides an exemption from public records requirements for specified patient safety data and certain information identifying health care practitioners and facilities held by the Florida Patient Safety Corporation and associated entities; provides an exemption from public meeting requirements for portions of meetings held by such corporation or associated entities. Provides for future legislative review and repeal. Effective July 1, 2004.

Ch. 2004-71 (C.S. for S.B. 1650)  Revises provisions relating to state retirement programs and investment of state funds. Effective July 1, 2004.

Ch. 2004-72 (C.S. for S.B. 2736)  Increases the fee for commercial crawfish trapping; includes crawfish traps in the Fish and Wildlife Conservation Commission’s trap retrieval program. Effective July 1, 2004.

Ch. 2004-73 (H.B. 237)  Provides a period during which the sale of certain books, clothing, and school supplies will not be subject to sales tax; provides for a period during which the tax on motor fuel will be reduced by 8 cents per gallon. Effective May 20, 2004.

Ch. 2004-74 (H.B. 1613)  Creates and revises provisions relating to vessel safety. Effective May 20, 2004.

Ch. 2004-75 (S.B. 276)  Exempts vessels owned by Safe Harbor Haven, Inc., from certain vessel registration taxes. Effective July 1, 2004.

Ch. 2004-76 (C.S. for C.S. for S.B. 562)  Revises provisions relating to electrical and alarm system contracting. Effective July 1, 2004.

Ch. 2004-77 (C.S. for S.B. 1070)  Provides that specified eminent domain provisions apply to certain natural gas transmission pipeline entities. Effective May 21, 2004.

Ch. 2004-78 (S.B. 1430)  Permits certified advanced registered nurse practitioners to conduct required physical examinations for law enforcement and correctional officers. Effective July 1, 2004.

Ch. 2004-79 (S.B. 1620)  Extends the term of provisions requiring certain criminal history record checks prior to the sale or delivery of firearms to a person other than a licensed importer, manufacturer, dealer, or collector. Effective May 21, 2004.

Ch. 2004-80 (S.B. 1728)  Permits certain condominiums, condominium associations, unit owners, and cooperatives to opt out of specified retrofitting requirements; prescribes limits. Effective July 1, 2004.

Ch. 2004-81 (S.B. 1774)  Requires that certain governmental entities do specified background checks prior to appointment or employment of persons at parks, playgrounds, day care centers, or other places where children regularly congregate. Effective May 21, 2004.

Ch. 2004-82 (C.S. for S.B. 1926)  Creates and revises provisions relating to workers’ compensation insurers. Effective July 1, 2004.

Ch. 2004-83 (C.S. for S.B. 1934)  Provides for the construction of the term “official state business” to include certain breaks and stops by law enforcement officers during normal duty hours; provides for reimbursement for property damage coverage for state-owned vehicles used for off-duty work. Effective July 1, 2004.

Ch. 2004-84 (S.B. 2132)  Redesignates the Florida Construction Industries Recovery Fund as the Florida Homeowners’ Construction Recovery Fund; creates and revises provisions relating to the fund. Effective July 1, 2004.

Ch. 2004-85 (C.S. for S.B. 2562)  Revises provisions relating to money transmitters. Effective May 21, 2004.

Ch. 2004-86 (C.S. for C.S. for S.B. 2704)  Creates a public records exemption for personal identifying information of a child or the child’s parent or guardian held by a children’s service council, juvenile welfare board, or other specified entity. Provides for future legislative review and repeal. Effective July 1, 2004.

Ch. 2004-87 (C.S. for S.B. 2720)  Authorizes waiver of certain requirements for public accountant licensure applicants under specified circumstances; requires completion of continuing education hours in ethics as a prerequisite to license renewal. Effective July 1, 2004.

Ch. 2004-88 (H.B. 333)  Provides specified entities with immunity from civil liability for personal injury or wrongful death related to long-term consumption of certain foods or nonalcoholic beverages under certain circumstances; provide exceptions. Effective May 21, 2004.

Ch. 2004-89 (H.B. 639)  Redefines the term “covered claim” in regards to insurance guaranty associations to exclude certain claims rejected by another state’s guaranty fund; provides exceptions. Effective May 21, 2004.

Ch. 2004-90 (H.B. 679)  Expands the definitions of specified terms relating to sales representative contracts involving commissions to include businesses, business employees, services, and products; increases damages under certain actions for compliance; provides exceptions. Amendments To The State Constitution

H.J.R. 1  Proposes creation of s. 22, Art. X of the State Constitution to prohibit legislative limitation or denial of privacy rights guaranteed to a minor by the United States Constitution as interpreted by the United States Supreme Court; and authorizes legislation providing for notification of a pregnant minor’s parent or guardian prior to termination of the pregnancy. To be submitted to the electorate for approval or rejection at the general election to be held on November 2, 2004.

S.J.R. 2394  Proposes amendments to s. 10, Art. IV and s. 5, Art. XI of the State Constitution to revise the deadline for filing a constitutional amendment proposed by initiative with the Secretary of State and to revise the time period for a Supreme Court advisory opinion as to the validity of an initiative petition.
